La campagna Open Access Now chiede l’accesso incondizionato per i membri della società civile e per i giornalisti ai centri di detenzione per immigrati. Ha contribuito a sottolineare e ricordare che l’opacità continua a circondare questi luoghi di detenzione: ostacoli incontrati dalle ONG, dai ricercatori, dalle famiglie e dagli amici dei migranti, dai cittadini per accedere alle informazioni, difficoltà di contatto con i detenuti, ostacoli alle azioni di sostegno e alle campagne di sensibilizzazione e di advocacy su questi temi.
Nell’ambito di questa campagna, ogni anno un certo numero di membri dei parlamenti europei e nazionali si sono attivati, affermando il loro diritto – garantito dalla legge – a visitare i siti di detenzione. Gli obiettivi della campagna erano:
rafforzare la sorveglianza dei cittadini su queste strutture;
sottolineare la necessità di trasparenza;
dare maggiore visibilità ai problemi legati alla detenzione dei migranti.
Queste visite hanno avuto lo scopo di incoraggiare la riforma delle leggi nazionali ed europee per aumentare il rispetto dei diritti umani. Nel 2013, queste visite sono state effettuate in un totale di 21 luoghi di detenzione situati in Belgio, Cipro, Spagna, Francia, Italia e Libano.
Il numero dei luoghi di detenzione è in costante aumento. La capacità totale nota – due terzi dei quali si trovano all’interno dell’UE – è di circa 37.000 persone. Questa, tuttavia, rimane una stima. Non solo il numero effettivo di detenuti è spesso superiore alla capacità ufficiale, ma le autorità utilizzano anche una serie di siti di detenzione che non sono elencati nelle statistiche ufficiali.
Il progetto collaborativo “Mappatura dinamica della detenzione dei migranti” sta lavorando alla Mappa dei campi inclusa nella piattaforma Closethecamps.org, creata congiuntamente, con l’obiettivo di facilitare l’accesso alle informazioni sulla detenzione degli immigrati e le sue conseguenze sulla vita e i diritti dei migranti.
ATTIVITÀ DI ADVOCACY
La Routinizzazione della detenzione amministrativa dei migranti e la libera circolazione dei cittadini: È tempo di esplorare le alternative. Questo incontro è stato il risultato di un impegno continuo a livello europeo che ha coinvolto tutte le organizzazioni della società civile finora coinvolte nella difesa dei diritti dei migranti e nella libera circolazione dei cittadini. Nel contesto di una rinnovata preoccupazione e coinvolgimento dei cittadini di tutta Europa nella questione dei diritti dei migranti, della revisione della “direttiva sul rimpatrio” e della preparazione delle elezioni europee, è riuscito a riunire i rappresentanti dei governi nazionali, del Parlamento europeo e della società civile per esplorare i modi in cui la detenzione di migranti, richiedenti asilo e rifugiati può essere evitata a livello europeo.
Sempre nell’ambito della campagna “Open Access Now”, abbiamo anche organizzato insieme ai nostri partner Migreurop e OEE (Observatory on the Detention of Migrants) un forum internazionale sulla detenzione dei migranti in Europa e nella regione del Mediterraneo, tenutosi a Parigi venerdì 6 dicembre 2013, sotto il titolo “Migrant detention in Europe and Beyond”: Quali prospettive? Questo forum ha riunito oltre 200 partecipanti provenienti da una grande varietà di contesti e da diversi paesi dell’UE ed extra-UE, tra cui ricercatori, giornalisti, vari attivisti, rappresentanti di ONG e migranti, tutti coinvolti o interessati a fare campagna e a informare sulla detenzione dei migranti e a sfidare la politica e la pratica della detenzione per condividere e scambiare le loro esperienze e le loro opinioni. È stata un’altra importante opportunità per discutere di varie questioni critiche relative alla detenzione dei migranti nei principali paesi europei e del Mediterraneo, valutando anche il potenziale delle azioni della società civile nella mobilitazione della consapevolezza pubblica intorno a questi problemi, soprattutto dopo l’ultimo disastro delle imbarcazioni dei migranti al largo di Lampedusa.
European Alternatives e altri promotori della campagna “Open Access Now” e le organizzazioni aderenti hanno partecipato attivamente al processo promosso da Melting Pot Europe e da molte altre organizzazioni della società civile il 4 ottobre 2013 all’indomani della tragedia di Lampedusa. Questo processo ha portato allo sviluppo di una proposta più completa: “La Carta di Lampedusa” e la ricerca della legittimità democratica delle politiche migratorie dell’UE.
