The Spanish government has passed a law reclassifying peaceful protest as a \u201cthreat to public security\u201d and introducing\u00a0\u00a0hefty fines up to \u20ac600,000 for those joining demonstrations near sensitive targets \u2013 including government buildings.<\/p>\n

The \u201cunauthorised\u201d use of images of security forces will also draw a \u20ac30,000 fine, in a clear attempt to intimidate journalists and citizens who document police abuses.<\/p>\n

You can even be prosecuted for a tweet – if it contains a hashtag publicising an unauthorised political event.<\/p>\n

The law is due to come into force in July.<\/p>\n

The measure is clearly aimed at the resurgence in civic participation and protest that followed the 15M Movement in Spain and that represents the main force behind the rise of Podemos.<\/p>\n

Maina Kiai, United Nations special rapporteur for the rights to freedom of assembly and association, has asked the Spanish government to reject the measure, arguing that \u201cthe rights to peaceful protest and to collectively express an opinion are fundamental to the existence of a free and democratic society.\u201d<\/p>\n

Criminalising peaceful protest, intimidating journalists, and attacking the electoral base of a political competitor are actions that Spaniards have left behind together with the Franco regime.<\/p>\n

Mariano Rajoy has no right to drag Spain backwards.<\/p>\n

European Alternatives strongly condemns the actions of the Spanish government, and calls upon the European Commission to raise the violation of basic democratic rights with the Spanish authorities as a matter of urgency.<\/p>\n

Spain is not the only country clamping down on free assembly and expression at the moment. The European Commission should create a monitoring mechanism for threats to fundamental rights and civic space and have quick legal mechanisms for preventing member states undermining European values.<\/p>\n

El gobierno espa\u00f1ol ha aprobado una ley que clasifica la protesta pac\u00edfica como una “amenaza para la seguridad p\u00fablica” e introduce multas de hasta \u20ac 600.000 \u20ac para aquellas personas que participen en manifestaciones cerca de lugares de alta sensibilidad – incluyendo edificios del gobierno.<\/p>\n

Las fotograf\u00edas “no autorizadas” de las fuerzas de seguridad tambi\u00e9n podr\u00edan significar multas de \u20ac 30.000, en un claro intento de intimidar a periodistas y ciudadanos que documentan abusos policiales. Se puede incluso ser procesado por un tweet si \u00e9ste contiene un hashtag publicitando un evento pol\u00edtico no autorizado.<\/p>\n

La ley entrar\u00e1 en vigor en julio. La medida es una evidente respuesta al resurgimiento de la participaci\u00f3n c\u00edvica y de la protesta a partir del Movimiento 15M en Espa\u00f1a, que adem\u00e1s es el principal motor del ascenso de Podemos.<\/p>\n

Maina Kiai, Relatora de las Naciones Unidas para los derechos a la libertad de reuni\u00f3n y asociaci\u00f3n, ha pedido al Gobierno espa\u00f1ol que detenga dicha medida, argumentando que “el derecho a la protesta pac\u00edfica y a expresar colectivamente una opini\u00f3n son fundamentales para la existencia de una sociedad libre y democr\u00e1tica”.<\/p>\n

La criminalizaci\u00f3n de la protesta pac\u00edfica, intimidar a los periodistas, as\u00ed como erosionar la base electoral de un competidor pol\u00edtico son legados de un pasado que los espa\u00f1oles decidieron dejar atr\u00e1s con el fin del r\u00e9gimen franquista. Mariano Rajoy no tiene derecho a obligar a Espa\u00f1a a retroceder en la historia.<\/p>\n

Alternativas Europeas condena en\u00e9rgicamente las acciones del gobierno espa\u00f1ol, y pide a la Comisi\u00f3n Europea que aborde esta violaci\u00f3n de los derechos democr\u00e1ticos b\u00e1sicos con car\u00e1cter de urgencia.<\/p>\n

Actualmente, Espa\u00f1a no es el \u00fanico pa\u00eds imponiendo medidas dr\u00e1sticas contra la libertad de reuni\u00f3n y de expresi\u00f3n. La Comisi\u00f3n Europea deber\u00eda por lo tanto crear un mecanismo de seguimiento de amenazas a los derechos fundamentales y los espacios c\u00edvicos, as\u00ed como contar con mecanismos legales r\u00e1pidos para prevenir que los Estados Miembros socaven los valores europeos.<\/p>\n","protected":false},"excerpt":{"rendered":"
